General Terms and Conditions

 

Bookings

  1. The rental agreement is concluded upon advance payment for a certain rental period for an apartment.
  2. The contract applies to the respective guest, the landlord (Berlin Beds) and obliges both the landlord and those customers who have made a booking without being a guest themselves. If a customer has booked on behalf of a guest, they are jointly and severally liable to the landlord together with the guest.
  3. a) The conclusion of the accommodation/rental agreement obliges the contracting parties to fulfil the contract for its entire duration. The contract cannot be terminated unilaterally.
    b) Option bookings are binding for both contracting parties. The landlord reserves the right to allocate the reserved rooms/event spaces elsewhere after the option booking expires.
    c) Booked function rooms are available to the contracting partner only during the agreed times. Use beyond this requires prior arrangement with the landlord.
    d) For all group bookings, the landlord must receive a participant list 14 working days before the group’s arrival.
  4. The guest is obliged to complete the registration form upon arrival, unless they have already checked in online via the website provided.
  5. a) If the guest does not arrive during check-in times on the agreed arrival date, the landlord is entitled to allocate the room(s) elsewhere, unless the guest/customer has informed the landlord in advance.
    b) If the guest has reserved accommodation for several days and does not arrive on the scheduled day, the landlord assumes that the guest/customer has withdrawn from the confirmed reservation, unless a later arrival has been communicated or the guest arrives by 11:00 AM the following day at the latest.
    c) In cases a) and b), the guest is obliged to pay cancellation fees. The customer/guest retains the right to claim higher actual saved expenses and higher actual benefits obtained from alternative use.
  6. The room(s) must be vacated by 10:00 AM on the departure day. If the guest fails to ensure the room(s) are available at this time by vacating and settling the bill, the landlord may charge the full price for the additional day and clear the apartment if another guest has booked it.
  7. Berlin Beds reserves the right to rebook guests to other apartments at the same price. Rebooking is preferably to new apartments of equal or better quality, size, and price. Should the booked or alternative apartments be unavailable for technical reasons, Berlin Beds will refund the guest the price difference to the new apartment’s booking price.
  8. We do not offer smoking rooms. Smoking is permitted in outdoor areas only at specially designated spots. If smoking occurs in the apartment nonetheless, we cannot rent the room for at least 5 additional days as the smell persists and other guests will not want to stay. Cleaning costs of at least 150 EUR will be charged, as well as the loss from non-rentability of at least 500 EUR, which are to be paid by the guest. If the guest violates the smoking ban, the guest must leave the room immediately and pay these costs. If smoking is discovered after checkout – e.g., by cleaning staff with an additional witness – these costs are also to be paid by the guest. The statement of the cleaning staff and the landlord serves as evidence.
  9. The guest has a special duty of care towards all furnishings of the landlord and must ensure careful treatment within the provided accommodation. In case of improper use of the room, the landlord has the right of extraordinary termination. Moving furniture or using chairs from the apartment in outdoor areas is not permitted.
  10. As a general rule, the guest may not receive visitors in their room without first obtaining the landlord’s consent. Filming videos or video clips intended for publication is not permitted.
  11. Overnight stays by persons other than those registered with the landlord are also not permitted.
  12. Animals may not be brought into the rented premises. If this is not observed and the guest departs for this reason, this does not release them from the obligation to pay cancellation fees.
  13. Insofar as the guest is offered the opportunity to park their vehicle on a parking space belonging to the landlord, parking is at the guest’s own risk. The landlord has no duty of custody or safekeeping.
  14. If the guest notices any defects, particularly in the area of the rental room, these must be reported immediately so that the landlord has the opportunity to remedy reported defects promptly. A defect that is only claimed upon departure does not lead to a reduction in the room price if the landlord was not aware of this defect.
  15. In case of key loss, the costs for the resulting damage and replacement are to be borne by the person responsible. The cost of losing a hotel key is 200 EUR, as it belongs to a master key system.
  16. The house rules – available online and in the room as a folder – are incorporated into the above rental agreement and are binding for all guests. In case of serious violations of the house rules, extraordinary termination is possible. If a guest deliberately violates the house rules or endangers the well-being and safety of our staff or other guests through their behaviour, we are entitled to exercise our domiciliary rights and issue a house ban against the guest. The house ban takes effect immediately. There is no longer any entitlement to the remaining booked days. There is no right to a refund.

Cancellations

  1. After confirmation of the room reservation, we keep a room in the desired category available as agreed. Changes or cancellations result in losses that we cannot bear alone. We do not wish to deter our future guests with the following contractual conditions, but should you be forced not to make your trip, please contact us.
    1. To avoid incurring costs, we recommend that you take out travel cancellation insurance.
    2. Cancellations are only valid if received by us in writing (including by email). In case of cancellation, we will of course try to rent the rooms or apartment(s) elsewhere. For regular guests, cancellation fees may be waived on a case-by-case basis depending on the pre-reservation period. Otherwise, cancellation of a confirmed booking, whether in written, telephone or verbal form, will be charged according to the following table.

Termination by Berlin Beds

  1. Berlin Beds is entitled to terminate accommodation contracts (even after the room(s) have been occupied) with immediate effect and, in exercise of its domiciliary rights, to expel the guest or guest group from the premises if the guest or guest group damages the reputation, security, or standing of the landlord, is suspected of committing criminal offences, or harasses, disturbs, or endangers other guests, residents, passers-by, or neighbours.
  2. In particular, violations by the guest or guest group of the provisions of the Terms and Conditions or the house rules, as well as damage, soiling, or theft of hotel property, entitle Berlin Beds to terminate the contract with immediate effect. This also applies if the guest uses the room or other premises for a purpose other than that agreed. In these cases, the guest is obliged to pay damages and for accommodation already used, as well as for accommodation not yet used in accordance with the cancellation regulations.
  3. This also applies to all other accommodation contracts in cases of force majeure or for other important reasons within the mutually agreed cancellation regulations.

House Rules

  1. Quiet hours are from 10 PM to 7 AM, please be considerate of other guests.
  2. The kitchen must be left clean, rubbish must be removed from the apartment. Moving furniture is not permitted.
  3. Should the kitchen not be left clean or rubbish not be disposed of, we are unfortunately obliged to charge a cleaning fee from 50 EUR.
  4. The WiFi connection is only suitable for internet browsing, short messages, and emails, not for TV or streaming films, as the bandwidth is insufficient and other guests would then be unable to use the internet.
  5. The heating must not be on during the day when the apartment is unoccupied. Windows must be kept closed in winter unless ventilating (see also below).
  6. Ventilating in winter: Please ventilate the apartment by „shock ventilating“ for 3-5 minutes with windows wide open, possibly with a draught from multiple windows. Otherwise, windows must be kept closed.
  7. If windows are left open in winter with the heating turned up, this will be charged to the guest at 15 EUR per day per room.
  8. The landlord inspects the apartments daily to identify any problems. The landlord may turn down the heating, close windows, and point out any violations of the house rules. The guest must grant the landlord access to the apartment.
  9. Please use the provided slippers – entering the apartment in street shoes is not permitted.
  10. Parking is free. Please always park so that the white boundary lines are not crossed, otherwise the entrance is too narrow. For long vehicles, please use the parking spaces on the north side (Bucher Chaussee), which are larger.
  11. Check-out is by 10 AM. Please leave the key on the table in the apartment.
  12. You can dispose of rubbish at the waste containers located at the first car entrance on Lindenberger Str. (see map). Please use the appropriate bins (blue: paper, black: residual waste, plastic: yellow bags). If you need additional bin bags, please contact the management.
  13. Smoking is not permitted. Smoking is only allowed outdoors at the specially designated smoking areas. Smoking in the parking areas is not permitted. No cigarette butts on the ground.
  14. In outdoor areas: Loud groups, loud phone calls, and the consumption of alcohol and cannabis are not permitted.
  15. Electronic devices brought by the guest such as laptops, tablets, smartphones, shavers, etc. must not be left charging in the absence of the guest. Should a fire in the room/apartment be caused by a device brought by the guest, the guest is liable for all resulting damages.
  16. Larger electrical appliances – in particular electric scooters (e-scooters), electric refrigerators or similar devices – must not be brought into or operated in the apartments. Devices with a battery, especially electric scooters and other battery-powered vehicles or devices, must under no circumstances be brought into or charged in the apartments due to the increased risk of fire. Should such a device cause a fire, the guest shall be liable to the operator for all resulting damage.
  17. Keep music, television, or conversations at room volume. No parties.
  18. Pets are not permitted.
  19. Rearranging furnishings, bringing in own furniture, and storing moving boxes or other large items is not permitted.
  20. Price list for additional services

    • Interim cleaning of the apartment incl. bed linen and towels: From 25 EUR for a small apartment up to 90 EUR for a 5-room apartment.

 

Event Room

  1. Subletting or further rental of function rooms, exhibition or advertising space requires the written approval of the landlord.
  2. Brought – not „introduced“ within the meaning of Section 702 BGB – exhibition or other items are in the event rooms or on the premises at the customer’s/guest’s own risk. Except in cases of gross negligence or intent, the landlord assumes no liability for loss, destruction, or damage. Brought exhibition parts or other items must be removed immediately after the event. If the customer/guest fails to do so, the landlord may arrange removal and storage at the customer’s expense. The landlord may charge room rent for the duration that items remain in the event room. Attaching presentation materials or other items without the landlord’s consent is not permitted. All decorative materials must comply with fire safety requirements. Valuables, money, and monetary instruments (cheques, cheque cards, etc.) must be deposited in the hotel safe at reception.
  3. If the landlord has reasonable grounds to believe that the event threatens to jeopardise the smooth running of business, the safety, or the reputation of the house or its guests, as well as in cases of force majeure or civil unrest, the event may be cancelled; any claims for damages against the landlord are excluded.
  4. Newspaper advertisements containing the apartment building’s details for invitations, sales events, and job interviews, or the use of the apartment building for the contracting partner’s promotional measures, always require prior written consent from the landlord. If publication occurs without the landlord’s consent and this impairs essential interests of the apartment building, the landlord has the right to cancel the event; in this case, payment will be insisted upon.
  5. For communal meals, the organiser must provide the landlord with the exact number of participants 3 working days before the event begins. This number counts as guaranteed.
  6. Bringing food and beverages is generally not permitted. Exceptions are only possible in consultation with the landlord and upon payment of the customary service charges/corkage fee.
  7. Circumstances that prompted the guest/customer to enter into the rental agreement but which, for reasons beyond the guest’s/customer’s control, do not materialise (e.g., cancellation of a trade fair, etc.) do not lead to the contract being unwound under the legal doctrine of frustration of contract.
  8. Insofar as the landlord arranges third-party services of a technical, decorative, or other nature for the organiser, it acts in the name and for the account of the organiser. The organiser is liable for the careful handling and proper return of these items and indemnifies the landlord against all third-party claims.

General Provisions

  1. For the safety of guests, surveillance cameras are installed in the outdoor areas around the apartments. By booking an apartment, the customer agrees that images/videos may be recorded and used in accordance with the GDPR.
  2. The apartment/room may be entered during the guest’s stay for the purpose of cleaning or carrying out necessary repairs by staff or the owner if performing such work themselves, as well as in justified exceptional cases (concrete suspicion of damage) or in case of danger.
  3. Items left behind by the customer/guest will only be forwarded upon request, at the risk and expense of the customer. Any liability of the landlord is excluded in this regard.
  4. Insofar as the accommodation cannot be provided for reasons within the landlord’s risk sphere, the landlord is not liable for compensation for wasted holiday time. Otherwise, the landlord is only liable for intent or gross negligence of the legal representatives of the landlord company or the landlord’s vicarious agents.
  5. If changes in the statutory VAT rate occur between the conclusion of the contract and the start of the first overnight stay, the guest/customer agrees that the agreed price will change accordingly with the VAT change.
  6. The landlord has a right to cash payment for all services before departure/upon arrival and accordingly a statutory lien on the guest’s brought-in belongings. If the landlord has agreed advance payments on the accommodation price with the customer/guest, the landlord is entitled to extraordinary termination of the contract if the customer does not pay at the due date. The right to cancellation fees remains unaffected. In case of cancellation of the room booking, the customer/guest is obliged to pay cancellation fees, subject to other individual agreements.
  7. Disruptions to provided technical or other facilities will be remedied immediately where possible. However, withholding or reducing payments is not permissible. Set-off against counterclaims is excluded, unless the counterclaims are undisputed or legally established.
  8. Messages intended for guests as well as postal and goods deliveries are handled with care. The landlord undertakes storage, delivery, and upon request, unfranked forwarding. However, liability for loss, delay, or damage is excluded.
  9. Invoices sent are payable within 1 working day without deduction.
  10. The landlord accepts the following credit cards: Maestro, Visa, and Mastercard.
  11. If the period between contract conclusion and service provision exceeds 180 days, the landlord reserves the right to make price changes without prior notice.
  12. Services not used from package agreements will not be refunded.
  13. The place of jurisdiction and place of performance for the landlord’s services to non-merchants is the respective location. Verbal side agreements have not been made. Changes or additions to the contract require written form.
  14. Liability for brochures or internet content is excluded.
  15. The landlord charges a flat fee of 15 EUR for each guest/staff change.
  16. For cash payments, the landlord does not accept 500 EUR banknotes or banknotes in foreign currencies.
  17. For the guest/customer who is a merchant, Bernau bei Berlin is agreed as the place of jurisdiction. German law applies.
